Okay, let's not split hairs here. The intent of the card is simple:
Would you call a hat when talking about it to someone else in normal conversation? I don't know about you, but I call helmets "helmets" when I'm talking about them. I don't call them hats in colloquial speech.
There is always that one person who shows up to a tournament, though, hence the need to clarify. No, I wouldn't call a helmet a hat, either, but some might decide that Ninja is wearing a hood rather than a hat.
The Masterful Ninja is a special case. The arguments of "hat" versus "no hat" are equally valid but I would conclude that since we cannot see the being involved we will err on the side of caution and say "no hat"--hats can it more difficult to hide yourself. That being said, I did a little LARPing way back in college (early 90s, in the early days of that activity) and my simple homemade outfit consisted of a black cloak (made it myself), a black scarf tied around my face, black gloves, and a black fedora and I *still* managed to sneak up on someone from the front in the daylight.
This card does open up the possibility of some interesting equipment though. Fahsionable Hat, artifact equipment, cost 1, equip 1, with "If the equipped creature's art portrays it as not wearing a hat, its art now counts as portraying it as it it were wearing a hat".

I mean, a hard hat would be both. It's a sturdy helmet to protect from impacts, but it also rests atop your head. Duh. Bicycle helmets are where we really start splitting hairs.

When you think about it, "Hard Hat" itself sounds as an equipment from an unset, it's such a silly name. In most other languages I'm aware of, the name for it is "helmet", "protective helmet", "industrial helmet", etc. I think only English uses "Hard Hat".
