I have not posted on this site or played Magic in over 4 months, but when I heard about R_E's situation I knew that I had to come back and show my support for what he has done for the Magic community since when we all gathered on MTGNews. WOTC are idiots, this game used to be about having fun and winning prizes now it has changed into a money-driven powerhouse which will stop at nothing to get what the want. I hope R_E makes it through alright because its seems that WOTC has decided to leave a loyal fan out to dry just to prove a point.
Wizards _is_ suing RE for the posting of information related to Guildpact.
Wizards is also suing RE based on the posting of three play test cards related to SNAP and the November 15, 2005 posting of the "planned trade name for the SNAP expansion set."
The suit alleges 5 counts - 1. Misappropriation of trade secrets under R.C.W. 19.108 based on the posting of "the name of an upcoming expansion set of cards, play test cards, and information from the unreleased Guildpact expansion card set on the MTG Salvation website without Wizards' consent." 2. Copyright infringement based upon the release of copyrighted information without a license. 3. Contributory infringement. 4. Breach of contract (against the doe defendants). 5. Unjust enrichment.
Okay, lets go over the charges.
Starting with:
#5. RE is not guilty. Wizards would have to prove that RE would himself benefit monetariliy through these leaks and that would entail either through his website or mtgsally him making a profit. This would be near impossible to prove.
#4. Irrelevant to R_E.
#3 Now here's an interesting charge, and this one is undoubtably true and RE is guilty. When it came go GP and other older sets being spoiled ahead of time, RE did indeed contribute to copyright infringement. There should be no question on this one, as RE has beleived certain spoilers to be accurate, he therefore has been contributing to copy right infringment of others.
#2. See #3.
#1. Now here's a murky one. We have two interesting cases here. ONE: R_E did posts cards of the SNP expansion that did have the copyright WOTC on the bottom. TWO: R_E claimed that he doubted these were real. Now if RE can prove he didnt believe they were real but thought itd be interesting to see RM reaction he might be able to get off on this one.
Overall, RE is in trouble from 2 of these charges (maybe 3) and should try settling with WOTC. Problem is, i dont think RE knows his sources' names, so im not sure if he can give WOTC what they want.

I love Joboman, Poggy, Niv, and Vezok, because, while they may not be the best players, they still try to win. Having fun is the most important thing to a game, but I've learned that if you don't try to win, then you're ruining everyone else's fun.
