That's not what the issue is. The issue is that Pink Floyd did nothing illegal and the family, if they decide to press charges, has no legal leg to stand on. Pink Floyd did nothing wrong. He did not implicate that the image in question was child porn, he just said "lol, just saw a naked picture of a girl from my school" which is equivilant to "lol, just saw a naked picture of a girl on 4chan."
Neither can get you arrested. In fact, if anyone is to blame here it would be whoever posted in the picture onto tumblr and if Pink Floyd is persecuted for talking about the image in question, free speech is destroyed if all the others who talked about image in question are not punished as well.

Note that admitting guilt and denying guilt are not the only two options. For instance, saying "I did not post any nude pictures of so-and-so.", is truthful while not admitting or denying guilt for breaking any potential laws we don't know about due to lack of information.

1. The Image In Question is uploaded to tumblr.
2. Pink Floyd sees the image and posts on his facebook status "lol, just saw a naked picture of a girl who went to my school"
3. Cian's sister blogs with a link and an upload of the picture.
4. The comments on cian's status are deleted along with the status.
The root cause of the issue here is not Pink Floyd, but the uploader of the image. If charges can be pressed on defamation of character, they need to be pressed on Cian's sister, those who slandered the girl via Cian's status, and the uploader of the image onto tumblr.

Demand a lawyer from the school be present if nothing else. If they are serious about expelling you they will likely comply and get shut down by their own lawyer since nothing you did was illegal or occured at school.

The facts provided by Pinkfloyd seem to be getting skewed by some self righteous people while asserting their "advice". The reality of the situation is he did nothing wrong, other than provide completely vague statement which other people too nosy for their own good took it upon themselves to sleuth out. And that status is the reason for his sister posting the link and other probably obscene/malicious comments. He has a part in this, obviously it has become a big enough deal that local authorities and the school are involved. He just cannot deny his part of it, and trying to deny his part is the worst thing to do.
Free Speech covers a lot of things, but it can be twisted around many ways. And in this case, the free speech is leading to something that is a very serious issue, child porn. People do not and will not mess around with this issue, it causes media frenzies and brings out an entire demographic of supporters. Using free speech will not work, because his free speech led to illegal pornography, and while he wasn't the one posting he it he is a part of it.
I feel like I am repeating my self a lot so lets get this one issue straight, and it is pretty obvious. Unless the girls parents are dropping charges(lol goodluck there) he is a part of this. At this point we are under damage control. Blame everybody else, this ship will be going down so take everybody with you, friends, family, facebook, tumblr just blame everybody. I couldn't contact my grandmother so I had full intent of when I get to school to request not to talk to the parents. When I arrived and went to the office I found out my year level coordinator just wanted to speak to me (someone who just deals with year 12, we have one for each year level)
The first thing she says is "You are in no trouble at all". I immediately felt fine. Apparently after a nights rest the parents decided they did not want to sue me for anything. After that she said to me that I should just be wary of my actions online and that this could have ended up much worse, like someone killing themselves. Apparently she was "not in the right state of mind" when she took the picture, which I just think is a lie and a way to get out of it.
She apologized about making a big deal out of it and even getting the police involved. Even offered to get extensions for all my assignments. Funnily enough, I found out other people that were interviewed before me she told their folks that "A boy posted the picture on facebook" and it was alright for her to tell a complete lie to them because she didn't mention MY name
So the girl is coming back to school Monday and I promised I wont discuss the issue or talk to her (I don't want to anyway). I have 2 weeks of proper work left, 1 week of exams then year 12 week, preparing for schoolies and leaving. I am happy to be done with high school and move to Europe.

The root cause of the issue here is not Pink Floyd, but the uploader of the image. If charges can be pressed on defamation of character, they need to be pressed on Cian's sister, those who slandered the girl via Cian's status, and the uploader of the image onto tumblr.

But he started it, I have stated that the blame should be put onto those other parties. Though, if he doesn't post his status, does this still get spread? You can't prove yes or no off of an assumption. He is a part of this now, like his sister is and everybody else. His best bet is to stand his ground by admitting what he did and pushing for the blame on said other parties. If he goes I didn't do anything wrong it hurts his case.
Put your lawyer hat on tighter and think about it, he is your client, this has gone all the way to court now(granted I am basing this off the US legal system so sorry if things are run differently down under) and you are trying to convince a jury that your client did nothing wrong. The girl's family is trying to get him on slander and the school is trying to expel him and the authorities want him for child porn. How do you win by starting off your argument with, he didn't do anything? He started it, you have to admit that. Did he do it to be hurtful, was this supposed to happen, was he involved with the naked picture? No, but you can't say he didn't do anything.
There is evidence, obviously the police have it, and facebook doesn't delete stuff, those things stay on forever. They will easily have the entire status thread to point blame. You start off on a better footing by proving his status was just lol nudes, instead of saying he did nothing, when it is so easy to show he did.
Along with the complete and utter vagueness of the statement, completely lacking any detail whatsoever, is the same as spreading the image around which he saw? As far as I'm concerned, that's like pirating music and getting caught and fined by the RIAA and then trying to blame the person that told you bittorrents exist. The facts provided by Pinkfloyd seem to be getting skewed by some self righteous people while asserting their "advice". The reality of the situation is he did nothing wrong, other than provide completely vague statement which other people too nosy for their own good took it upon themselves to sleuth out. The only people guilty of anything are the people that actually reposted the blog with damn pictures like a bunch of tools, all of which whom weren't Pinkfloyd. Never did he state who, or where, according to the information given, and I'll be surprised if there's only one single girl in his high school for others to suspect he was talking about.

Freedom of speech. The first amendment protects Pink Floyd's right to post this status in the way he did. The police cannot arrest him for child porn because he never possessed the porn in question.
He did not start this, the person who posted the original picture started it.

Hey guess what I'm currently majoring in Political Science and I have some news for you: you are incorrect. The linking or spreading of child porn is a crime. I'm also prone to believe he could be sued.
Oh and one more thing you may find important: The First Amendment of the United States constitution does not apply to Australia.
He asked in the United States, how would you defend him.
Cian did not link or spread the child porn in question, therefore he did nothing illegal.

Edit: Also while ninja editing your post to add some extra points hoping it might validate your argument is cool and all, he did state that the girl was underage, so to quote you: "please learn how to read"
He never stated the girl was underaged in the original status.
Going off what Cian has told us, he simply posted "lol nudes of girl I know" with no link, no name, and no age, and other brought attention to it. Therefore, blame goes to those bringing the attention, not Cian.

You don't have to state explicitly something is child porn for it to be child porn. Actually I think in most cases nobody ever states that what they have is child porn. So once again, blame goes to PinkFloyd, and everyone else involved. Pretty much every point you have brought up does not add up to "PinkFloyd did nothing wrong" and you are giving some real bad advice right now dude.
Yes, and you are missing the point, he still has to admit to posting his status, and therefore, he is still involved in this. And, denying that fact would cause trouble. Everyone is saying, don't admit to anything, that it will show guilt, but it is too late for that, all of what has happened is because of his lol nudes status and he has to admit to it.
The whole point of this thread is to see whether or not pinkfloyd did anything wrong, and posting his status spurred the comments and links to alleged child porn. And that status is the reason for his sister posting the link and other probably obscene/malicious comments. He has a part in this, obviously it has become a big enough deal that local authorities and the school are involved. He just cannot deny his part of it, and trying to deny his part is the worst thing to do.
Free Speech covers a lot of things, but it can be twisted around many ways. And in this case, the free speech is leading to something that is a very serious issue, child porn. People do not and will not mess around with this issue, it causes media frenzies and brings out an entire demographic of supporters. Using free speech will not work, because his free speech led to illegal pornography, and while he wasn't the one posting he it he is a part of it.
I feel like I am repeating my self a lot so lets get this one issue straight, and it is pretty obvious. Unless the girls parents are dropping charges(lol goodluck there) he is a part of this. At this point we are under damage control. Blame everybody else, this ship will be going down so take everybody with you, friends, family, facebook, tumblr just blame everybody. He is stuck, this is not good in Australia, the USA, any court.

And fwiw two years of "pre-law" and a poli-sci degree (do you have the degree or did you just take classes?) isn't exactly something you should be using to make yourself seem more knowledgable anyway, because your first two years of college being "pre-law" means absolutely nothing.

Firstly, everythingwentbetterthanexpected.jpg
I couldn't contact my grandmother so I had full intent of when I get to school to request not to talk to the parents. When I arrived and went to the office I found out my year level coordinator just wanted to speak to me (someone who just deals with year 12, we have one for each year level)
The first thing she says is "You are in no trouble at all". I immediately felt fine. Apparently after a nights rest the parents decided they did not want to sue me for anything. I went on to tell my YLC (year level coordinator) I never posted the link or mentioned her name, which for some reason everyone was told I did. After that she said to me that I should just be wary of my actions online and that this could have ended up much worse, like someone killing themselves. Apparently she was "not in the right state of mind" when she took the picture, which I just think is a lie and a way to get out of it.
She apologized about making a big deal out of it and even getting the police involved. Even offered to get extensions for all my assignments. Funnily enough, I found out other people that were interviewed before me she told their folks that "A boy posted the picture on facebook" and it was alright for her to tell a complete lie to them because she didn't mention MY name
So the girl is coming back to school Monday and I promised I wont discuss the issue or talk to her (I don't want to anyway). I have 2 weeks of proper work left, 1 week of exams then year 12 week, preparing for schoolies and leaving. I am happy to be done with high school and move to Europe.
Thank you to everyone who gave me advice in this thread and to Kijin, Kpaca and \m/ >.< \m/ , I will take this as a life lesson and stay away from gossip online.
