4. The actual video I saw had the original artist rotate their picture and have the silhouette of their drawing (including the claws, when slightly repositioned) identically match with Crux of Fate.
5. Note that the 5-clawed Bolas on Crux and this fan-art clash with most other depictions, which give bolas only three digits (look at meditation realms) To make precisely the same error beyond having the same exact silhouette does not look good for this guy.
6. Even if you are right that no laws were broken, tracing other people’s works without crediting them is universally reviled in all visual mediums I can name. Wizards not wanting to be associated with outrage from the public because their artist was a jerk is an understandable business move.
7. “Not having a case” is kind of beside the point, as indicated by point 6. I have seen nothing suggesting that scarypet is seeking to make a lawsuit and having a legal case is only relevant in that context.
This is a long-running gag in MTG with claims that their designs were stolen.
This is why when I first started MTG development back on Wizards Community, I 'encrypted' a large amount of my designs, and entire projects were put forward as a 'proxy' to gauge for the response of other posters, as well as for the content that would be later released under the MTG brand. I proxied entire character profiles, world building, and story lines. The results were as expected, and stereotypical abroad. They were also anecdotal, and nothing I could do with other than prove personal points and make a personal case for. It gets even deeper than that, regarding suspicions that the MTG had been neglecting the business and were making designs that cater to the success of their third-party singles market. But that's another story for another time.
I would suggest the same is true for out friend here though. It is a similar likeness, but it's simply not identical.
The claws are different, the texture is different, and the color palette is also different.
