You can't rely on a 4 mana sorcery in Legacy to put back overpriced/dead cards, not to mention that Bstorm is one of your best cards in conjunction with Counterbalance. The deck is simply too underpowered against other legacy decks if Bstorm were to become banned.

If it would be banned, you would replace it with the next best 1 mana cantrip, probably just like modern. That changes a lot ofcourse, but it wouldnt kill the deck at all.
If brainstorm is banned you can't run crap like entreat and terminus because as soon as they're in your hand you are relying on a 4 mana card in JTMS to put them back where you want them and why would you set up a wrath effect in terminus with jace when you could just, y'know, supreme verdict that can't be countered and requires no hoops to jump through. Top may be the best card in miracles but it is certainly not all the glue that holds it together. Ask Reid Duke or any expert with miracles if the deck could survive without brainstorm and all would and should say no. You can't just say 'replace it with ponder' either as the best miracles version at this point is ponder miracles/it already runs a bunch of copies in almost every list as the legends miracle list that Lossett favors is not mainstream at all. He just loves venser + karakas, plain and simple. Just go and try to play the deck without brainstorm and you'll see how pathetic it is especially in comparison to other avenues you could take in terms of control decks in a brainstormless legacy. All of this is a moot point as WotC has proven that they will not ban brainstorm time and time again. First misstep, then cruise, now DTT. How many more cards have to be banned from the blue shell before people realize that brainstorm is going to remain untouched by WotC in regards to legacy.

The key card clearly is Sensei's Divining Top , while Brainstorm is a constant blue powerhouse.

I remember when Memory Jar was banned before it was released. And Skullclamp was at one time banned from everything.
And Ensnaring Bridge? Really? It's the only thing that makes my 8 rack remotely viable.
Shullclump was never banned from Vintage (obv, only non-power-level reasons ban things from Vintage), nor ever restricted.
I felt like being a bit pedantic there.
